Terms and Conditions
The terms on which we provide arboricultural consulting, reports and tree work, and on which you may use this website.
About These Terms
These terms apply to your use of this website and to arboricultural consulting, reporting and tree services provided by Liverpool Tree Permit Services. Where we provide you with a written quote, scope or engagement for a specific job, that document applies together with these terms, and prevails to the extent of any inconsistency.
Quotes and Engagement
We provide a fixed quote before work begins. A quote is based on the information available to us at the time, including the property address, the trees identified, the scope described and any plans or Council correspondence you provide. If the scope, tree numbers, site access or Council requirements change, the quote may need to be revised before the additional work proceeds.
Accepting a quote, in writing or by instructing us to proceed, forms an agreement on these terms.
Arboricultural Reports
Reports are prepared by a Consulting Arborist for the client, the property and the purpose identified in the report. A report reflects the condition of the trees and the site circumstances observed at the time of inspection. Trees are living organisms and their condition can change, including as a result of weather, works, root disturbance, disease or damage.
A report is not a Council approval and does not guarantee a particular Council outcome. Determinations are made by Liverpool City Council or the relevant consent authority in accordance with its own controls and assessment process.
Reports must not be altered, partially reproduced in a way that changes their meaning, or relied upon by a third party or for a different property, project or purpose without our written consent.
Site Access and Client Responsibilities
You are responsible for providing safe access to the property and the trees to be assessed, for holding the authority of the property owner where you are not the owner, and for providing accurate information about the site, including the location of services where known. Where access to part of a tree or site is not available, the report will state the limitation.
Tree Work
Tree removal and pruning is carried out only where an approval, exemption or other lawful pathway has been established. Work is performed with reasonable care and skill and in accordance with the approved scope. Where conditions on site differ materially from those quoted, we will discuss the variation with you before proceeding.
Payment
Payment terms are stated in the quote or invoice. Reports and documentation remain our intellectual property until paid in full, and are provided for the purpose stated in the engagement.
Cancellation
If you need to cancel or reschedule a booked inspection or tree work, please give us as much notice as you can. Where we have already attended site or commenced preparation, a charge may apply for the work performed.
Liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law. To the extent permitted by law, our liability is limited to resupplying the relevant service or paying the cost of having it resupplied. We are not liable for loss arising from inaccurate or incomplete information provided to us, for decisions made by a consent authority, or for events outside our reasonable control.
Website Use
Content on this website is provided for general information. You may not reproduce, republish or commercially exploit the content of this website without our written permission.
Governing Law
These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction in relation to them.
